An Open Letter To All Consultant and Resident Doctors And Stockholders Of Bacolod Our Lady of Mercy Specialty Hospital
January 21, 2011 - It’s been a couple of weeks since the labor unrest sparked in the Hospital. The disorder was started by Dr. Evangeline C. Johnson, BOLMSH’s Chief Operating Officer when she illegally fired out 31 rank and file employees belonging to janitorial and orderlies including 7 union officers without due process. The mass lay off is so inhuman and inconsiderate because it was executed on the eve of New Year’s Day and it took effect immediately that day.
Whatever the Management called it “redundancy”, “cost cutting measure” or “outsourcing” it is very clear that it was UNION BUSTING. While the Management claimed that there is excessive work force as the reason of their “redundancy”, they continue to employ contractual workers from Integrated Management and General Services as replacements. It is very obvious that the redundancy aims to destroy workers unity in order to weaken the collective strength of the workers defending decent wages, jobs and trade union rights.
BOLMSH employees currently cannot avail Social Security System (SSS) benefits until 2013 because the Management is delinquent in paying our SSS. Despite the continued payroll deduction of employees’ share, the Management failed to remit the said contribution to the SSS. The employees’ share must be remitted to SSS and must not be misappropriated because we entrust them the said fund believing that they will rightfully pay to the said agency.
Bacolod Our Lady of Mercy Specialty Hospital Employees Union – a registered labor organization recently filed a case of llegal Dismissal, Unfair Labor Practice: Union Busting, with Money Claims for Backwages, Wage Differentials, Damages and Attorney’s Fees. Because we we’re illegally dismissed by the Management, we are demanding for REINSTATEMENT.
In this connection, Bacolod Our Lady of Mercy Specialty Hospital Employees Union appeal to all Consultant and Resident Doctors, Hospital Stockholders not to connive with Dr. Evangeline C. Johnson in changing the Management of the hospital without any conclusion of the recent labor dispute.
Therefore, we ask you to join us in our call to the Management to:
1. Stop the dismissals of workers and reinstate those who have been dismissed.
2. Respect BOLMSH workers’ right to freedom of association.
3. Give way to the Union’s Certification Election
4. Observe the strict compliance of labor standards in the workplace.
